Purpose of Data Processing

We process your personal data only in compliance with applicable data protection regulations. Your data, such as first name, last name, email address, mobile number, phone number, position, or function in the company, will only be processed under the following legal bases:
– To fulfill our contractual obligations or in relation to pre-contractual activities
– If processing is legally required
– If you have given your consent
– Based on our legitimate interests

Your data will be used for contacting and communicating regarding the respective matter.

We manage the data of our contacts (e.g., prospects, customers, suppliers, and partners) centrally in our ERP system. Additionally, your data may be stored and processed in our email program during email communication.

All employees of EK-Pack Folien GmbH have access to the ERP system if required for their role.

Legal Basis for Processing

The primary legal basis for processing your personal data is Article 6(1)(b) of the GDPR. Processing is necessary for the performance of a contract to which the data subject is a party or for carrying out pre-contractual measures.

In certain cases, processing is based on our legitimate interest under Article 6(1)(f) of the GDPR, or processing may also be legally required under Article 6(1)(c).

Storage Duration and Criteria for Determining the Duration

We store the data you provide only for as long as necessary to fulfill the above-mentioned purposes or as required by various statutory retention periods. For example, the retention period for your data may be derived from Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO). These regulations require every merchant to keep commercial books for ten years and commercial correspondence (including contract-related emails) for six years. The retention period begins at the end of the calendar year in which the last entry was made in the commercial books or the commercial correspondence was received or sent.

Once the respective purpose ceases to apply or the relevant retention periods expire, your data will be routinely blocked or deleted in accordance with legal regulations.

We have developed an internal company policy to ensure compliance with these procedures.

Disclosure of Your Data to Third Parties

We only transfer your personal data to third parties if this is legally permitted or if you have given your consent.

Where is the Data Processed?

The data is processed exclusively within the EU.
Your data is not transmitted to external entities.

Information on Your Rights as a Data Subject

You have the right to obtain information about the personal data concerning you. You may also request the correction of incorrect data. Additionally, under certain conditions, you have the right to request the deletion of your data, the restriction of data processing, and the right to data portability.

For processing activities where we obtain your consent (this is done individually with separate information obligations), you have the right to withdraw your consent at any time with effect for the future.
